Terms of Use

These Terms of Use set forth a legally binding contract between Us, and You and by using the Platform, you agree to the Terms of Use stated herein. The Terms of Use equally apply, even if You only visit the Platform or review any of the service offerings made available by Us and are bound by these Terms of Use. If you do not agree to these Terms of Use, please do not continue to access and use our Platform, henceforth.

In consideration of your use of the Disha Classes Website and Disha Classes App, You agree:

• To provide true, accurate, current and complete information about yourself complying with Clause 2 of this Terms of Use and as prompted in order to generate the login credentials.
• To the responsibility of ensuring that You meet the required qualification while opting for the courses subscribed.
• To maintain and promptly update your login credentials to keep it true, accurate, current and complete
• And acknowledge that Disha Classes is not responsible to ensure that You conform to the eligibility criteria
• To seek the consent of Your parents/legal guardians, in case you are a minor, before providing any information about Yourself or Your parents and other family members, on the Disha Classes App
• That We are not responsible or liable for any consequences, that arise as a result of misuse of any kind, by You, in the Disha Classes App, Disha Classes Website or any of Our services, such that it causes any harm or injury to a third-party.
• That We reserve the right to change and update the content in the Platform to represent the latest evidence and practices, with the changing times, needs and requirements. We reserve the right to constantly review, update and replace the content and features of all the Study Materials, including but not limited to Test Series, Videos and Notes, which would be carried out on a yearly basis in the form of ‘Editions’. We do not guarantee that any content or features, of the previous Edition, would be made available on the Platform in the new Edition.
• That We reserve all right to engage a different faculty or tutor or change the current faculty or tutor at any given point of time without any prior notification to the User.

Anyone is eligible to register for Disha Classes App and be a Registered User (defined hereunder). As a minor if you wish to use the Disha Classes App or Our Services, such use shall be made available to you by Your legal guardian or parents, who has agreed to these Terms. In the event a minor utilizes the Disha Classes App/ Disha Classes Website/Services, it is assumed that he/she has obtained the consent of the legal guardian or parents and such use is made available by the legal guardian or parents.

If You choose to purchase a paid subscription, You will be directed to the purchase page and have the option to select the services and duration for which You wish to become a Subscribed User. Upon receipt of the payment in full (or in Part, if such choice is given by the US), the user would become a “Subscribed User”. After the payment is made, You will receive a confirmation Email/SMS to the registered Email ID/Mobile Number confirming your plan details and credentials for accessing the Platform.

Post receipt of the payment in full, the user shall normally be required to submit their one valid identity proof issued by the Government of India i.e. Aadhaar Card, Passport, Voter’s ID, MCI card etc, as acceptable by Us. Upon submission of the valid identity proof, the Platform shall normally conduct a verification process of each such user. In such cases where the user has been asked to submit an identity proof, only on successful completion of the verification process by Us, You will attain the status of a Subscribed User.

To avail the full range of course content offered as part of the Services, You will have to mandatorily be a Subscribed User.

The Services and amounts payable to access the Services may differ for different Subscribers and will be based on the course combination chosen by You either at the time of enrolling as a Subscribed User or thereafter, based on the courses a Subscribed User adds to his/ her account.

In these Terms of Use, the term Services (hereinafter referred to as ‘services’) shall mean and include without limitation, the online tutorial videos and content as well as study materials that will be accessible to You as a Subscribed User and will exclude the free demo content that is accessible to all Registered Users visiting the Platform. The foregoing meaning and scope of Services may be subject to change and the definition shall not in any way limit or restrict Our right to remove or add features to the Platform.

As a “Registered User”, You are enrolled to the free plan by default and have the option to purchase a course and become a Subscribed User.

You agree that any Services provided by Us may be subject to change at Our discretion and We may add, remove or modify offerings to its existing scope of Services at such fees as will be solely determined by Us.

We may, at Our discretion, revise the amount payable in respect of existing offerings forming part of the Services that may be made available to You.

You agree that We may at any time and for any reason, terminate Your access to whole or part of the Platform, or restrict or suspend Your access to your Subscribed User account, for any or no reason, with or without prior notice, and without any liability to You.

If You use the Platform and wish to avail Services by creating a User account, You may be required to submit your phone number and/or email ID and choose a password which will be the only set of credentials, on the basis of which You will be granted access to the Platform and its Services. You are responsible for maintaining the confidentiality of Your password and other credentials to access the Services. If there is any compromise to Your account, You can change your password using the ‘Forgot Password’ functionality available on the login page used to access the Platform.

We may use/integrate another third party’s platform on Our Website or on Disha Classes App. We may also use third party platforms to provide services to ourselves. In such event, You will be bound by such third party’s terms and conditions, privacy policy, and any other applicable policies. You also agree and hereby authorize Disha Classes to share Your details and personal information with such third parties to the extent necessary for Disha Classes to deliver the Services to You.

• Any payments made to Disha Classes in respect of Services are subject to the payment terms of Disha Classes as will be notified to You once You initiate the process to become a Subscribed User.
• The Fee including GST and any delivery charges payable in relation to delivery of electronic/physical versions of document based Study materials, if applicable, will be shown prior to completion of the online payment transaction.
• In the unlikely event that, due to a technical error, the amount of the Fee displayed on the Platform is incorrect, Disha Classes will notify You as soon as it reasonably can. If the correct amount of the Fee is higher than the amount displayed on the Platform, Disha Classes will contact You through your registered e-mail address and/or phone number to notify You of the correct Fee.
• Disha Classes hereby notifies You that Disha Classes uses third party payment gateway service providers to process payment made by You towards the Service subscription. Disha Classes will not be responsible for any payment failures or errors occurring due to technical issues at the bank’s end or the third party’s payment gateway.
• The provision of the online tutorials forming part of the Services are contingent upon Disha Classes having received cleared funds from You in respect of the Fee for the relevant Service subscription.

The term ‘Study Materials’ as used in these Terms of Use include the videos, Test Series and any other learning material posted for the specific topics. We do not make any representation, guarantee or commitment to You that the Study Materials offered either in the demo versions or as part of subscribed services will be error free.

The MCQs provided in the Study Materials is inclusive of all kind of MCQs provided in the Study Material i.e., via test series, notes etc. The content will be constantly updated (addition or removal) in terms of its numbers and the material without any prior notice to You and at a sole discretion of Disha Classes.

We do not claim any guaranteed rank, mark, success/any kind of professional advantage with the use of the Platform.

We reserve the right to constantly review, update and replace the content and features of all the Study Materials, which would be carried out on a yearly/half-yearly/monthly basis in the form of ‘Editions’.

• Except as set out in the description of the subscription model available on the Platform, no additional study materials and/or video tutorials will be provided by Us.
• Upon receipt of a confirmation e-mail from Us you will be notified when You have access to purchased services and for the length of time such access will be made available.
• A subscription received is personal to You and You shall not transfer or share your right to access the Study Material or further sell the subscription. Such acts will result in suspension or termination of your account.

It is Your responsibility to check that the Mobile Phone, Tablet, Computer or any other device You plan to use to access the subscription is compatible with the minimum specification requirement. We cannot be held responsible for any technical problems with any systems or devices you encounter.

We reserve the right to make modifications, enhancements or issue clarifications (for example, clarification of doubt, interactive sessions) to the subscription, including but not limited to changes in Services, number of Services available, pricing and validity of Subscription duration.

These changes would be called as ‘Editions’ and we have complete discretion to update the same with time, as We deem fit and cannot be challenged by You at any time.

We do not warrant uninterrupted or error-free operation of the subscription. We are not obliged to offer You any technical support other than the specific support included in your plan.

We cannot be held responsible for delay or disruptions resulting from:

• Operation of the internet (including viruses)
• Network firewall restrictions
• Failures of telecommunications links and equipment
• Updated browser issues or DRM protocols preventing playback

We shall not be liable for any interference, virus, hacking, or any such consequence, caused by any network or internet service providers. SUBJECT TO APPLICABLE LAWS, IN NO EVENT WILL DISHA CLASSES’ AGGREGATE LIABILITY EXCEED THE PAYMENTS ACTUALLY RECEIVED AND RETAINED BY DISHA CLASSES FROM YOU.

The suggestions and recommendations provided by Us are only suggestions, and You may comply with them at Your choice and option. We offer various services via the Platform to help You prepare for exams like JEE, NEET, Civil Services (UPSC), and intend to expand into school/college classes and other competitive exams (NET, TET, CLAT, etc.).

We will process the information that We receive from You or otherwise hold about You in accordance with these Terms of Use and the Privacy Policy. You acknowledge that We may conduct online surveys from time to time to gauge Our services and collect demographic information.

A Disha Classes account is meant to be used by only one User. Sharing credentials for personal or commercial purposes will result in account blockage without prior notice.

Each user will have a fixed number of Fair Usage hours defined course-wise. If the limit is exceeded, the account will fall under scrutiny for investigation. Violation of this policy amounts to a substantial breach and may lead to permanent termination of the account.

You shall not use the Platform to host, upload, or transmit any material that:

• Is in violation of any applicable law or regulation.
• Infringes any copyright, trademark, or intellectual property rights.
• Is grossly harmful, harassing, defamatory, obscene, or racially objectionable.
• Harms minors in any way or impersonates another person.
• Contains software viruses or any code designed to interrupt or limit functionality.
• You shall not reverse engineer, decompile, or record any Study Material or video tutorials for further distribution or commercial benefit.

We reserve the right to cancel any subscription believed to be compromised or used fraudulently. Accounts will be blocked for:

• Usage of Rooted/Jailbroken Devices, Emulators, or Cloned APKs.
• Screen Casting, Screen Recording, or Screen Mirroring.
• Sharing Screenshots or PDFs on Social Media.
• Usage of Multiple Devices beyond permitted limits.
• Abusing Disha Classes faculties or attempting to sell account contents.

Disha Classes may access, preserve and disclose Your account information if required to do so by law or in a good faith belief that such access is reasonably necessary to comply with legal processes, enforce this agreement, respond to claims of rights violations, or protect the safety of the public.

You understand that the Services include security components that permit digital materials to be protected. You shall not attempt to override, disable, or circumvent any such security components, encryptions, and usage rules embedded into the Website or Services.

All materials on the Website, including logos, trademarks, images, videos, and software, are protected by intellectual property rights owned by Us. No Material may be copied, reproduced, sold, or distributed without Our prior express written permission. Any unauthorized attempt to modify or circumvent security features is strictly prohibited.

Tutors in tutorial videos are independent third parties and not employees of the Company. We disclaim all warranties as regards the authenticity or correctness of information communicated by tutors. Links to third-party apps or web pages are accessed at your own risk; hosting these links does not constitute an endorsement.

We provide a single, limited, non-transferable, and non-exclusive license to use the Platform for personal, non-commercial use. All content, including designs, text, and graphics, are the exclusive property of the Company. Modification or use of content on any other platform is a violation of copyright and proprietary rights.

This Agreement remains in effect while you use the Platform. You may terminate your subscription at any time; however, We do not offer refunds upon termination. We reserve the right to terminate Your access immediately if We believe you have breached any terms of this agreement.

We are not responsible for any data loss resulting from accessing tutorials or study materials. It is your responsibility to back up all data on your device.

The Platform and Services are intended for use within India. Those who access the Platform from other jurisdictions are responsible for compliance with local laws. All provisions of these Terms remain in full force and effect even if specific limitations are not applicable in certain jurisdictions.

You agree to defend and hold Us harmless from any claims, damages, or expenses arising from Your use of the Platform, Your violation of these Terms, or Your violation of any third-party rights.

Note: By using our platform, you authorize Disha Classes to contact you via email, phone, SMS, or WhatsApp for promotional purposes, irrespective of DND/NDNC registration.

• We reserve the right to modify or discontinue the Service at any time.
• These Terms of Use together with the Privacy Policy constitute the entire agreement between You and Disha Classes.
• Failure to enforce any right does not constitute a waiver of such right.
• These Terms are governed by the laws of India. Any matters arising shall be subject to the exclusive jurisdiction of courts located in Delhi.
